By accessing or using Plogig.com or its mobile applications (the “Platform”), you agree to be legally bound by these Terms of Use (“Terms”). These Terms constitute a binding agreement between you and Plogig. If you do not accept these Terms in their entirety, you may not access or use the Platform. Plogig reserves the right to update or amend these Terms at any time. Continued use of the Platform following the posting of any changes constitutes your acceptance of such changes.
Plogig is a technology platform that solely facilitates connections between clients seeking services (“Clients”) and independent third-party service providers (“Service Providers”). Plogig does not provide any services directly. Plogig is not a party to any agreement entered into between Clients and Service Providers, and does not monitor, control, or assume liability for the actions, quality, legality, safety, or any aspect of the services provided.
Plogig’s role is strictly limited to enabling the connection between Clients and Service Providers through its Platform. Plogig makes no guarantees or warranties regarding the qualifications, licensing, insurance, quality, or fitness of any Service Provider. You agree that any legal claim or dispute arising from the services received must be brought solely against the Service Provider and not against Plogig. Under no circumstances shall Plogig be held liable for any direct, indirect, incidental, consequential, punitive, or exemplary damages resulting from your use of the Platform or the services of any Service Provider.
You agree to use the Platform only for lawful purposes. You are solely responsible for verifying the credentials, identity, and suitability of any party you choose to engage with. You agree not to misrepresent your identity, use fraudulent means, or attempt to disrupt or misuse the Platform in any way. You agree to indemnify, defend, and hold harmless Plogig, its officers, employees, and affiliates from any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Platform.
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Plogig. Service Providers are not employees, agents, or representatives of Plogig. Plogig does not supervise, direct, or control Service Providers and is not responsible for their conduct.
Any disputes, claims, or controversies arising between Clients and Service Providers must be resolved solely between those parties. You waive the right to bring or assert any claim against Plogig related to such disputes. You agree to release Plogig from all liability, claims, demands, or damages of every kind and nature known or unknown, arising out of or in any way connected with such disputes or your interactions with Service Providers or other users of the Platform.
Plogig reserves the right to suspend or terminate your access to the Platform at any time, for any reason, without notice. These Terms remain in effect even after termination. Any violation of these Terms may result in legal action. Plogig reserves all rights and remedies under applicable law to enforce these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the courts located within Duval County, Florida, and you hereby consent to the jurisdiction and venue of such courts.
These Terms constitute the entire agreement between you and Plogig concerning the use of the Platform and supersede all prior or contemporaneous understandings. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
BY USING PLOGIG, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF USE. YOU FURTHER AGREE THAT THESE TERMS ARE ENFORCEABLE TO THE FULLEST EXTENT PERMITTED BY LAW.
